Health Assurance Hospitals Company (“DHAMAN”, “We”, “Our”, or “Us” ) has drafted this privacy policy (“Privacy Policy”) to ensure that you as a user (referred to in this Privacy Policy as “you”, “your”, or “user”) can clearly understand how we manage and safeguard personal information and data (“information”), Our personal information and data  security practices and policies and your rights in that regard.

The safeguarding and privacy of information is of the utmost importance to DHAMAN and it adopts all necessary systems of control in that regard.

This Privacy Policy describes the types of information We collect, how We use the information, and in what circumstances we may disclose your  information to a third party.

By using this website, you agree that (a)  you have read and understood this Privacy Policy in it its entirety; (b)  you consent, accept, and agree to be bound by the terms and conditions of this Privacy Policy.

Please read this Privacy Policy with due care and periodically as We may update it from time to time to reflect changes in Our operations and data management and security practices.

Information that We Collect.

When you visit Our website, We collect and store your  information (which is provided by you) so We can:

  1. where this is necessary for Us,  provide the applicant tracking services and other related recruitment services to you; and
  2. where We have a legitimate interest in collecting your information to provide the services you require from us and to customize your experience in a safe and easy way.

In general, you may browse the website without telling Us who you are or revealing any  information about you. However, when you complete forms with your  information and/or to submit your CV, We collect, process and use that information in accordance with this Privacy Policy and you would be no longer anonymous to Us. Such  information may include, but is not limited to, your name, phone numbers, email address, password, salary information, employment or education history, passport / civil id details, criminal records as well as the job postings you have applied for.  

How We Use the Information collected

We use the  information We collect to provide Our services and to communicate with you. By submitting your CV or job application, you acknowledge that any information you supply to Us may be used by Us to assess, evaluate and check your candidacy, which may include contacting any referees once We make a conditional offer of employment that you accept. You further acknowledge that We may make copies, reproduce, organize, modify, and analyze the information supplied.   

We may also pass your personal information to third parties where required to comply with applicable laws and to third party service providers solely for the purposes of processing and tracking your applications and making a selection decision. We will require the third parties to take the necessary steps to ensure that your information and data is kept secure and used in accordance with this Privacy Policy. In the event of a reorganization or sale of Our company or assets, your personal information may be transferred, subject to the acquirer accepting the commitments made in this Privacy Policy and compliance with the applicable laws.

How Long We Keep Your Personal Information

We may keep your personal information for so long as We need to in order to fulfill the purposes set out in this Privacy Policy.  When We no longer need to use your personal information and there is no need for Us to keep it to comply with Our legal and regulatory obligations, or to resolve disputes or enforce Our agreements, We shall remove it from Our systems.

 Meeting the requirements of Data Privacy Laws

DHAMAN will comply with all applicable data protection and privacy laws and regulations in the performance of its obligations. In complying with such applicable laws, DHAMAN will comply with all relevant laws and regulations in the State of Kuwait, including but not limited to Law. No. 20 of 2014 concerning electronic transactions (the “Privacy Law”)

Under the Privacy Law, you have a number of rights with regards to how We handle and process your  personal information. These include your rights to:

  1. Be notified about the personal information that is being collected about you and the purpose for which it is processed;
  2. Request and receive a copy of your personal information that We hold about you;
  3. Request the correction or deletion of your personal information (in order for Us to best support you in this matter, you should provide Us with the evidence supporting your request).
  4. Provide a complaint where you believe We may have not complied with the Privacy Law concerning electronic transactions or any of its implementing requirements.

If you wish to access, correct, update or delete your  information, you can do so at any time by logging into the website and managing your account settings.

Whilst DHAMAN treats the privacy of information with the utmost importance and maintains all necessary systems and safeguards in that regard, DHAMAN shall not be liable for any unauthorized use of your information and data by third parties. Moreover, in the event DHAMAN includes any URL shortcuts in the website to any of its partners or affiliate’s websites, DHAMAN shall not be liable for the unauthorized use of or your  information.

To the fullest extent permitted by applicable law or regulations, neither DHAMAN nor any  other third party, service provider or affiliate acting on behalf of or in conjunction with DHAMAN or any authorized contractor, affiliate or service provider acting on behalf of or in conjunction with DHAMAN (“Service Providers”) nor any of the respective owners, shareholders, directors, officers, employees, agents, consultants or representatives of any Service Providers shall be responsible for any proceedings, claims, liabilities, costs, fees (including attorney fees), expenses, delays, losses, penalties or other damages  (howsoever arising) caused to you or any other third party arising out of or in connection with this Privacy Policy.

Updates or Changes to Our Privacy Policy

Our Privacy Policy and Terms of Service may change from time to time. DHAMAN reserves the right, at its discretion and in compliance with applicable laws, to modify this Privacy Policy at any time by posting a notice on the Site.

You will be responsible for reviewing and becoming familiar with any such modifications. The revised Privacy Policy will be effective immediately for users who accept the Privacy Policy on or after the revision date.

General

Any dispute relating to the enforcement, interpretation, or application if this Privacy Policy shall be governed by and construed in accordance with the law of Kuwait. Any dispute arising out of or in connection with this Privacy Policy shall be dealt with through the courts of Kuwait to the exclusion of all others.

In the event any of these terms and conditions of this Privacy Policy should be determined to be illegal, invalid, or otherwise unenforceable by reason of any applicable laws or regulations; such provisions shall be severed and deleted from this Privacy Policy. To the extent reasonably possible, all other terms and conditions included in this Privacy Policy shall remain in full force and effect and continue to be binding and enforceable.
